01 Acceptance of Terms
These Terms of Service ("Terms") govern access to and use of healingmindstudio.com (the "Website"). By continuing to use the Website, you unconditionally agree to these Terms. If you do not agree, stop using the Website immediately.
These Terms are between you and Healing Mind Studio (Ganna Skrypnyk, LMFT). We may update these Terms at any time by publishing a revised version on the Website with a new effective date.
02 Description of Website and Services
The Website provides information about psychotherapy services offered by Ganna Skrypnyk, LMFT, and tools to request a consultation. Services include individual therapy, couples therapy, teen therapy, and coaching delivered through online sessions for California residents.
Information published on the Website is for informational purposes only and is not medical advice, a diagnosis, or a treatment order.
When you use the Website, analytics and advertising technologies (Google Analytics, Google Ads, Facebook Pixel) may be used only with your explicit consent through the cookie settings banner. See Cookie Policy for details.
03 No Therapeutic Relationship
Viewing the Website, submitting the contact form, or any other use of the Website does not create a therapeutic, counseling, or other professional relationship between you and the provider. A therapeutic relationship is established only after:
- completion of an intake interview and fit assessment,
- signing consent to treatment and informed consent documents,
- formal approval by the therapist to begin services.
Before a formal therapeutic relationship is established, information submitted through the Website is not legally confidential in the professional-privilege sense.
04 Qualifications and Licensure
Ganna Skrypnyk is a Licensed Marriage and Family Therapist (LMFT) in the State of California. License status can be verified on the official website of the California Board of Behavioral Sciences (BBS): www.bbs.ca.gov.
Psychotherapy, telehealth, and coaching services are provided in strict compliance with the California Business and Professions Code (Cal. BPC) and applicable CAMFT professional standards (California Association of Marriage and Family Therapists).
05 Telehealth Services
All psychotherapy services are delivered via telehealth (video sessions through a secure HIPAA-compliant platform) in accordance with Cal. BPC § 2290.5.
5.1 Client Requirements
- During each session, the client must be physically located in California (unless otherwise permitted by applicable interstate telehealth laws or exemptions).
- The client must disclose their exact location at the start of every session.
- Participation in telehealth sessions requires reliable internet access and suitable technical equipment.
5.2 Telehealth Informed Consent
Before treatment begins, you will sign a separate telehealth informed consent document covering technical requirements, potential limitations and risks of remote care, emergency procedures, and the platform's confidentiality policy.
5.3 Telehealth Limitations
Telehealth may be inappropriate for acute psychosis, active suicidal crisis, need for involuntary hospitalization, or other situations requiring in-person intervention. In such cases, the therapist will refer you to appropriate resources.
06 Eligibility Requirements
To receive psychotherapy services, you must:
- Be at least 18 years old (or 13-17 with parental or legal guardian consent).
- Be physically located in California during sessions.
- Complete an initial fit assessment.
- Have technical equipment and connection that support video sessions.
We reserve the right to decline services or refer a client to another provider if client needs exceed our scope of competence or if the therapy format is considered unsuitable.
07 Appointment Scheduling and Cancellation Policy
7.1 Scheduling
A session is considered booked only after confirmation from the therapist. A request submitted through the website form does not guarantee availability.
7.2 Cancellation and Rescheduling
You must cancel or reschedule at least 48 hours before the session start time. Late cancellation or no-show without a valid reason is charged at the full session fee. Exception applies for documented emergencies.
7.3 Late Arrival
If you are 15 minutes late or more without notice, the session may be treated as a missed appointment.
08 Payment and Insurance
We accept the following insurance plans: Blue Shield of California, Aetna, Anthem Blue Cross California, Carelon Behavioral Health, Quest Behavioral Health, and Cigna.
The client is responsible for:
- Copays, deductibles, and coinsurance required by their insurance plan.
- Fees for services not covered by insurance.
- Full service cost for self-pay (out-of-pocket).
Rates and financial terms are discussed before treatment begins and documented in a separate services agreement.
Under the No Surprises Act (2022), you have the right to request an estimate of expected charges before receiving services. Contact us for your Good Faith Estimate.
09 Confidentiality and Mandatory Reporting
Confidentiality is a core part of therapy. Information disclosed during sessions is not shared without your written authorization, except in circumstances required by California law, including:
- Threat to life: a serious and credible threat of harm to an identifiable third party (Tarasoff v. Regents, Cal. Civ. Code § 43.92).
- Suicidal emergency: emergency hospitalization when there is imminent danger to the client's life.
- Mandatory reporting: suspected abuse of children, elders, or dependent adults, and sexual abuse (Cal. Penal Code § 11166, Welfare & Institutions Code § 15630).
- Court requirements: court order or other lawful disclosure requirement.
10 Intellectual Property
All Website content, including text, images, logos, design, and source code, is the property of Healing Mind Studio and is protected by copyright law (Copyright Act, 17 U.S.C. § 101 et seq.) and other intellectual property laws.
You may not copy, distribute, reproduce, or create derivative works based on Website content without written permission.
11 Limitation of Liability
The Website is provided on an "as is" and "as available" basis without express or implied warranties.
To the maximum extent permitted by applicable law, Healing Mind Studio is not liable for:
- Indirect, incidental, special, or consequential damages,
- Lost profits or data loss,
- Acts or omissions of third parties,
- Temporary Website unavailability.
This limitation does not apply to intentional misconduct, gross negligence, or any situation where limitation of liability is prohibited under California law (Cal. Civ. Code § 1668).
Important. Nothing in these Terms limits liability for professional malpractice within licensed psychotherapy practice. Such liability is governed by separate laws and professional standards.
12 Indemnification
You agree to indemnify Healing Mind Studio and its staff for any damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or applicable law.
13 Governing Law and Jurisdiction
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any disputes arising from Website use or service delivery must be brought in courts located in Orange County, California, or, where federal jurisdiction applies, in the U.S. District Court for the Central District of California.
14 Dispute Resolution
The parties agree to make good-faith efforts to resolve disputes through negotiation before filing in court. If no resolution is reached within 30 days, either party may proceed to court as provided in Section 13.
Nothing in this section prevents filing complaints with regulatory bodies (BBS, CAMFT) or seeking judicial relief where permitted.
15 Miscellaneous
Entire Agreement. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Healing Mind Studio regarding Website use.
Severability. If any provision of these Terms is found invalid, the remaining provisions remain in full force.
No Waiver. Failure to enforce any right does not constitute a waiver of that right.
Assignment. You may not assign rights under these Terms without our written consent.
